1. The contract between us

We must receive payment of the whole of the price for the goods that you order before your order can be accepted. Payment of the price for the goods represents an offer on your part to purchase the goods, which will be accepted by us only when the goods are dispatched. Only at this point is a legally binding contract created between us.

2. Acknowledgement of your order

To enable us to process your order, you will need to provide us with your email address. We will notify you by email as soon as possible to confirm receipt of your order and to confirm details.

For the avoidance of doubt, this correspondence does not constitute a contract between us.

3. Ownership of rights

All rights, including copyright, in this website are owned by or licensed to Second Helping Limited. Any use of this website or its contents, including copying or storing it in whole or part, other than for your own personal, non-commercial use, is prohibited without our permission.

You may not modify, distribute, or repost anything on this website for any purpose.

4. Accuracy of content

We have taken care in the preparation of the content of this website, in particular to ensure that prices quoted are correct at the time of publishing and that all goods have been described accurately.

However, orders will only be processed if there are no material errors in the description of the goods or their prices as advertised on this website.

Any weights, dimensions, and capacities given about the goods are approximate only.

5. Damage to your computer

We try to ensure that this website is free from viruses or defects. However, we cannot guarantee that your use of this website or any websites accessible through it will not cause damage to your computer.

It is your responsibility to ensure that the right equipment is available to use the website.

Except in the case of negligence on our part, we will not be liable to any person for any loss or damage which may arise to computer equipment as a result of using this website.

6. Availability

All orders are subject to acceptance and availability.

If the goods you have ordered are not available from stock, we will contact you by email or phone (if you have provided your details). You will have the option either to wait until the item is available from stock or to cancel your order.

7. Ordering error

You are able to correct errors on your order up to the point at which you click "Pay now" during the ordering process.

8. Price

The prices payable for goods that you order are as set out on our website.

All prices are inclusive of VAT at the current rates and are correct at the time of entering information.

Where it is not possible to accept your order to buy goods of the specification and description at the price indicated, we will advise you by email and offer to sell you the goods at the price stated in the email.

9. Payment terms

We will take payment upon receipt of your order from your credit or debit card.

We accept no liability if a delivery is delayed because you did not provide correct payment details.

If it is not possible to obtain full payment for the goods from you, then we may refuse to process your order and/or suspend any further deliveries to you.

10. Delivery charges

Delivery charges vary according to the type of goods ordered.

11. Delivery

11.1

Details on delivery and returns can be found on our Shipping page.

We ship to most destinations worldwide, although it may not be possible for us to deliver to certain locations due to legal, customs, carrier, or operational restrictions.

11.2

We will deliver the goods to the address specified in your order. It is important that this address is accurate.

We cannot accept liability for any loss or damage to the goods once they have been delivered in accordance with your delivery instructions unless caused by our negligence.

We aim to deliver goods by the estimated delivery date, however delivery times are not guaranteed.

In any event, we aim to deliver goods within 30 days from the day after we receive your order.

11.3

You become the owner of the goods once they have been delivered to you.

Once delivered, the goods are held at your own risk and we will not be liable for their loss or destruction.

12. Risk and ownership

Ownership of the goods passes to you once full payment has been received and the goods have been delivered.

Risk of loss or damage passes to you upon delivery.

If you choose to use your own courier, risk passes to you as soon as the goods are handed to your courier.

13. Cancellation rights

13.1

Under The Consumer Contracts Regulations 2013, you have the legal right to cancel your order up to 14 calendar days after receiving your goods, excluding made-to-order items.

13.2

If you wish to cancel your order, please notify us by email.

13.3

You cannot cancel your contract if the goods ordered are bespoke or made to order.

13.4

If you have received the goods before cancelling your contract, you must return them to us at your own cost and risk.

13.5

Once we have received the returned goods, or evidence that they have been returned, we will refund any payment within 14 calendar days.

13.6

We may make a deduction from your refund for any loss in value caused by unnecessary handling.

14. Cancellation by us

We reserve the right not to process your order if:

  • We have insufficient stock

  • We do not deliver to your area

  • A product was listed at an incorrect price due to an error

If we do not process your order for these reasons, we will notify you by email and refund any payment taken as soon as possible.

15. If there is a problem with the goods

15.1

We are under a legal duty to supply goods that are in conformity with this contract and in accordance with the Consumer Rights Act 2015.

15.3

If you wish to exercise your legal rights relating to faulty goods, you must return them to us or allow us to collect them where appropriate.

We will cover reasonable postage or collection costs.

16. Liability

16.1

If you do not receive goods within 30 days and choose to cancel rather than rearrange delivery, we will provide a full refund.

16.2

We are only responsible for losses that are a natural and foreseeable consequence of our breach of these terms.

16.3

We do not accept liability for business-related losses including lost profits, lost revenue, or business interruption.

16.4

You are responsible for complying with all applicable import, customs, and local regulations relating to your order.

16.5

Nothing in these terms excludes or limits liability for death or personal injury caused by negligence or affects your statutory consumer rights.

17. Product guarantees

We ensure all products are made to a high standard and undergo careful quality control.

However, natural variations in colour, finish, shape, and texture are part of the character of many handcrafted products and should be expected.

As many of our products are handmade or hand-finished, slight variations in colour, brushwork, glazing, shape, size, and finish are part of their character and should not be considered defects.

Product photography is intended as a guide only. Colours, finishes, and appearance may vary slightly depending on screen settings, lighting conditions, and the handcrafted nature of our products.

Our guarantees do not cover:

  • Accidental damage

  • General wear and tear

  • Improper use or storage

  • Cosmetic damage that does not affect functionality

  • Failure to follow care instructions

  • Commercial use of products

  • Damage caused by harsh cleaning products

18. Circumstances Beyond Our Control

We shall not be liable for any delay or failure to perform our obligations under these terms where such delay or failure results from circumstances beyond our reasonable control, including but not limited to severe weather, natural disasters, strikes, transport disruptions, supplier failures, power outages, governmental actions, customs delays, or other unforeseen events.

These terms and any contract brought into being through use of this website are governed by English law.

Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.

All contracts are concluded in English.

22. Invalidity

If any part of these terms is found to be unenforceable, the remaining provisions shall continue to apply.

23. Privacy

You acknowledge and agree to be bound by the terms of our Privacy Policy.

24. Third party rights

Nothing in this Agreement is intended to confer rights on any third party.

25. Other important terms

We encourage customers to contact us directly in the first instance so that we can work to resolve any concerns as quickly and fairly as possible.
